169. The representative of Argentina said that her delegation shared the concerns voiced by India and Brazil regarding the Dutch seizure of generic medicines in transit. Argentina believed that authorities taking such decisions had to take into account the necessity to facilitate access to medicines for developing and least-developed countries. The detention of transiting goods in the Netherlands was not in line with Article V of GATT, with the spirit of TRIPS and the flexibilities contained therein, nor with the Doha Declaration on the TRIPS Agreement and Public Health.
