H.E. Ambassador Lundeg Purevsuren
13 INTELLECTUAL PROPERTY AND THE PUBLIC INTEREST: THE WTO TRIPS AGREEMENT AND THE COPYRIGHT THREE-STEP TEST

354.   Indonesia welcomes this opportunity, and views positively the inclusion of IP and the Public Interest in the agenda of the TRIPS Council Meeting. We also would like to thank South Africa for circulating document IP/C/W/663. The debate on the WTO TRIPS Agreement and the copyright three-step test is certainly of interest to our delegation. 355.   As everyone presumably knows, in the area of exception and limitation in intellectual property, the three-step test is embodied in the Berne Convention and the TRIPS Agreement. There are some debates on interpretation of three-step test for implementation in national level. The Delegation of Indonesia supports the discussion for the WTO TRIPS Agreement and the copyright three-step test on the agenda and we see South Africa's proposal as a good first step to reach for common understanding about the interpretation of the three-step test.

The Council took note of the statements made.
