The Trade Marks (Earlier Trade Marks) Regulations 2008
The Regulations amend the Trade Marks Act 1994 and correct errors and omissions. International trade marks are put on the same footing as Community trade marks. A further amendment disapplies the requirement to satisfy the 'use conditions' where an earlier trade mark relied on by the person opposing the registration of a mark or applying for a declaration of invalidity is a well-known mark entitled to protection under the Paris Convention or TRIPS Agreement.
