The Trade Marks (Amendment) Rules 2004
The Rules amend the Trade Marks Rules 2000. The amendments include the introduction of a new opposition procedure, where in certain cases, before evidence is filed, the registrar notifies the parties if it appears that a particular mark should or should not be registered. The Rules also amend the procedure surrounding the cooling-off period and introduce the requirement to show use of certain earlier trade marks which a person opposing the registration of a trade mark uses as the basis of the opposition. Other amendments made are consequential on the changes made to the rules relating to the opposition proceedings and various forms. Amendments clarify the circumstances in which an application can be divided. Further amendments make changes to revocation and invalidation proceedings and the filing of evidence.
