The Trade Marks (Relative Grounds) Order 2007
The Order changes the way in which applications for new UK trade marks are examined against earlier conflicting trade marks. The changes mean that a new application will only be refused registration (on the basis of an earlier conflicting mark) if the proprietor of the earlier mark succeeds in opposition proceedings against registration of the mark.
