The Trade Marks and Trade Marks (Fees) (Amendment) Rules 2012
The Rules amend the Trade Marks Rules 2008 to remove the obligation to provide notifications to proprietors of Community and International (EC) trade marks. The Rules remove the procedure for the merger of trade mark applications before marks have been registered pursuant to those applications. The Rules also provide that an application for a merger can only be made in respect of marks that have the same renewal date. An application for merger of marks which are subject to revocation or invalidation proceedings or which are the subject of an international registration pursuant to the Madrid Protocol, is prohibited. The Rules contain a consequential amendment to the Trade Marks (Fees) Rules 2008.
