Law of Ukraine No 815-IX "On Amendments to Certain Legislative Acts of Ukraine on Strengthening the Security and Protection of Rights to Trademarks and Industrial Designs and Combating Patent Abuse"
The Law introduced the following changes regarding trademarks: • clarifies the grounds for refusal to register the trademarks and its invalidation; • provides the possibility of registration for a collective trademark; • clarifies the procedure for granting legal protection to trademarks under international registrations (according to the Madrid system); • strengthens sanctions (penalties) for trademarks infringements; regarding industrial designs: • introduces additional criteria for industrial design protection (individual character); • provides the possibility of legal protection for unregistered industrial designs; • sets the total term of validity - no more than 25 years (instead of 15 years); • changes the type of protective document (certificate instead of the patent); • provides for the post-grant opposition procedure for revocation of industrial design certificates to the Appeals Chamber (fight against the so-called «patent abuse»).
