Technical Cooperation Activities under TRIPS Art. 67. - View details of the document

At its meeting of 6 July 2022, the Council for TRIPS agreed to invite intergovernmental organization observers to the Council to update the information on their technical and financial cooperation programmes relating to the implementation of the TRIPS Agreement.

This document reports on the technical cooperation activities concerning the Agreement on Trade‑Related Aspects of Intellectual Property Rights (TRIPS Agreement) that were undertaken between 1 October 2021 and 30 September 2022 by the Secretariat of the World Trade Organization (WTO). It covers activities that specifically relate to intellectual property (IP) and the TRIPS Agreement, as well as contributions to other activities of a broader character, which have a significant IP or TRIPS component. It follows the previous report to the Council for TRIPS, contained in document IP/C/R/TC/WTO-OMC/2, dated 7 October 2021. This cover note provides a general overview. More information on each activity is provided in the Annex.

1  MAIN ORIENTATIONS, TRENDS AND DEVELOPMENTS

  1. Technical cooperation activities, implemented by the WTO Secretariat under the aegis of TRIPS, have the objective of assisting Members and observers to meet their developmental and other domestic policy objectives, such as innovation and industrial policy, health, regulatory aspects, competition policy and environmental protection, through the trade and IP regime, in line with their domestic circumstances and priority needs. These activities also have the objective of strengthening the capacity of Members to fully participate in the WTO's work on TRIPS matters and to make assessments on the issues under examination or review.
  2. During the review period, the Secretariat's technical cooperation activities in relation to the TRIPS Agreement continued to focus on assisting Members and observers to understand their rights and obligations under the Agreement. Additionally, Members and observers continued to receive tailored assistance regarding notifications and reviews of national legislation. Activities are essentially driven by demand from developing country and least developed country (LDC) Members, as well as from governments preparing to accede to the WTO.
  3. Complementarity and cooperation with other intergovernmental organizations (IGOs) continue to be ensured in technical assistance activities organized by the WTO Secretariat. The February 2022 meeting of the Directors-General of the World Health Organization (WHO), the World Intellectual Property Organization (WIPO) and the WTO reaffirmed their commitment to enhance support to Members battling COVID-19 in the context of existing trilateral cooperation and took stock of a number of initiatives delivered during the reporting period. One such initiative included a WHO-WIPO-WTO Trilateral Workshop entitled: Accessing and Using Information Resources for the Pandemic Response. This Workshop was the second in a series of workshops to augment the flow of information on the pandemic. The WHO, WIPO and WTO Secretariats also launched the jointly developed WHO-WIPO-WTO COVID-19 Technical Assistance Platform in the six official languages of the United Nations. The Platform provides a one-stop shop that makes available the full range of expertise of the three organizations, and other partners, regarding the interface of public health, IP and trade matters in a coordinated and systematic manner. These initiatives follow the approach developed in the 2nd Edition of the WHO-WIPO-WTO Trilateral Study, 'Promoting Access to Medical Technologies and Innovation: Intersections between Public Health, Intellectual Property and Trade', published in 2020. Also during the reporting period, the WHO, WIPO and WTO Secretariats launched an updated extract of the Trilateral Study entitled 'Integrated health, trade and IP approach to respond to the COVID-19 pandemic'. Further, in March, to foster the dialogue between developed and LDC Members and to promote the use of transparency mechanisms, the Secretariat organized, in close collaboration with institutional partners, a virtual workshop on incentives for technology transfer to LDCs under Article 66.2 of the TRIPS Agreement. The workshop focused on fields of technology transfer critical for sustainable development, namely public health, agriculture and the environment, and involved close collaboration with IGO partners such as the UN Technology Bank, United Nations Framework Convention on Climate Change (UNFCCC), United Nations Environmental Programme (UNEP), UN Climate Technology Centre and Network (CTCN), among others.
  4. Members and observers have identified a wide range of challenges and interests related to IP and the TRIPS Agreement. Accordingly, technical cooperation activities have become increasingly more tailored to the specific needs of a Member or observer, or region. The Secretariat has in response evolved an ever more holistic approach, recognizing the situation of the TRIPS Agreement and policy choices within the TRIPS framework as integral to the broader policy context, and calling on a wider range of expertise. Moreover, technical assistance addresses the practical needs of policymakers to understand the interface between the TRIPS Agreement and other WTO Agreements, such as the Agreement on Agriculture, Agreement on Technical Barriers to Trade (TBT) and Agreement on the Application of Sanitary and Phytosanitary Measures (SPS), as well as with broader system-wide issues such as technology transfer, the environment, standards, the digital economy, and the links between trade and health. This benefits from close collaboration amongst different divisions in the Secretariat. The content delivered during thematic and multidisciplinary activities which took place during the reporting period – and the strong positive feedback received from participants, as well as the continuing high level of demand – confirm the successful implementation of this interdisciplinary approach.
  5. Throughout the period under review, TRIPS-related technical assistance continued to include training on TRIPS-related transparency mechanisms and monitoring. Following the February 2019 launch of the e-TRIPS Submission System, an online tool for WTO Members to submit notifications, review materials and reports related to the TRIPS Agreement, developed through consultation with the Council and with interested Members, the Secretariat has provided on-demand training sessions regarding TRIPS transparency mechanisms and how to use the e-TRIPS Submission System.
  6. The Secretariat was also invited to deliver TRIPS-related sessions in study programmes, training courses, seminars and workshops that were convened by a range of partners based in Geneva, in national capitals and in regional centres.

2  TECHNICAL COOPERATION RESOURCES

  1. Throughout the reporting period, the WTO produced an array of capacity building materials. For instance, a new book entitled 'Trade in Knowledge: Intellectual Property, Trade and Development in a Transformed Global Economy', launched at a webinar in March, was based on the insights from a capacity building workshop earlier convened with a range of officials from developing countries, and was developed as a fresh platform for considering the development dimension of the contemporary technological landscape for IP. To build on this platform, the Secretariat launched the WTO Trade in Knowledge portal, which provides materials aimed at helping policymakers and others keep abreast of current developments; understand the changing patterns of cross-border knowledge flows; and consider the legal, economic and policy dimensions.
  2. In line with the multidisciplinary approach to coherent public health, IP and trade policymaking, the WTO launched in July the WTO report 'Tackling Illicit Trade in Medical Products: Better international co-operation for better health'. This report was produced in close cooperation with IGO partners, including the Organisation for Economic Co-operation and Development (OECD), the United Nations Conference on Trade and Development (UNCTAD), the United Nations Industrial Development Organization (UNIDO), the United Nations Office on Drugs and Crime (UNODC), the World Customs Organization (WCO), the WHO and WIPO.
  3. As an outcome of the WHO, WIPO, WTO Workshop on Innovation in, and Access to, COVID-19 Technologies: Accessing and Using Information Resources for the Pandemic Response (see paragraph 12 below), the Secretariat in collaboration with partners published an Inventory of COVID-19 Information Resources. The inventory comprises a non-exhaustive list of COVID-19 information resources managed by international organizations, non-governmental organizations, academics and the private sector that has been compiled by the WTO Secretariat. It provides information on a variety of topics, such as vaccination, production of vaccines, government procurement, cases, diagnostics, therapeutics and IP-related issues.
  4. The e-TRIPS Submission System, an optional online tool for WTO Members to submit notifications, review materials and reports related to the TRIPS Agreement, and the e‑TRIPS Gateway, a database of the full range of TRIPS-related information managed by the Secretariat, continued to serve as key resources in technical cooperation activities involving TRIPS transparency mechanisms and monitoring, and the Secretariat actively supported a wide range of delegations and capital-based officials in making full use of these resources.
  5. During the reporting period the Secretariat continued to create new and refine existing capacity building materials, including case studies, questionnaires, video recordings and presentations.

3  TRIPS-RELATED SEMINARS, WORKSHOPS, TRAINING COURSES AND OTHER TECHNICAL COOPERATION ACTIVITIES

  1. In response to the continuing demand for thematic and interdisciplinary technical assistance, the Secretariat designed and delivered in close coordination with partners a number of global virtual activities focused on public health, IP and trade policy during the reporting period. The WHO, WIPO, WTO Workshop on Innovation in, and Access to, COVID-19 Technologies: Accessing and Using Information Resources for the Pandemic Response in February was the second in a series of WHO- WIPO-WTO trilateral workshops to augment the flow of information on the pandemic. This Workshop sought to enhance understanding of the characteristics, potential uses and limitations of select information sources, and included expert discussion on the use of data on epidemiological and other health-related issues; clinical trials; technological developments; intellectual property rights; and manufacturing and distribution of and access to technologies, as well as vaccination, diagnostics and treatment rates and cross-border flows of technology.
  2. Since 2018, with the participation of capital-based experts from LDCs, the Secretariat has organized an annual workshop on the implementation of Article 66.2: incentives for technology transfer to LDCs. The Secretariat has made continuous efforts to improve the value and impact of this annual dialogue between LDC Members and developed country Members. In 2022, the Workshop, which was designed and delivered in close coordination with LDC Members and intergovernmental organization (IGO) partners, was devoted to specific fields of technology transfer critical for sustainable development, namely, public health, agriculture and the environment. The Workshop featured highlights of a WTO survey on LDC needs and priorities for technology transfer, as well as a summary of developed country Members' annual reports (2021) on actions taken or planned in pursuance of their commitments under Article 66.2 of the TRIPS Agreement.
  3. The Secretariat continued to deliver technical assistance at the national and sub-regional level during the reporting period. For example, at the national level, a TRIPS module featured in a national workshop for Haiti, in July, and for Ecuador, in October. At the sub-regional level, a TRIPS module also featured in a Short Virtual Course on Trade Policy for Member Countries of the Latin American Integration Association (ALADI). The WTO Secretariat also took part in a sub-regional workshop hosted by WIPO and focused on public health and IP for Algeria and Tunisia, and a second sub- regional workshop for selected countries in the Arab region.
  4. As noted above, since the launch of the e-TRIPS Submission System, the WTO Secretariat has held both informal and ad hoc training sessions at Members' request.

4  WTO TRADE-RELATED TECHNICAL ASSISTANCE WITH A TRIPS COMPONENT

  1. The WTO Institute for Training and Technical Cooperation (ITTC) organizes many activities that include a significant TRIPS component. The Secretariat provided a comprehensive module on the TRIPS Agreement as part of the two WTO Regional Trade Policy Courses held during the reporting period: for Latin American Members and Observers and Asia-Pacific Members and Observers. Additional WTO trade-related technical assistance activities with a significant TRIPS component included the Virtual Executive Trade Course, introduction for WTO internship and trainee programmes, Virtual Introductory Trade Policy Course for LDCs and the in-person Advanced Trade Policy Course.
  2. WTO eLearning courses are the first step in the Progressive Learning Strategy that has been implemented by the WTO. Currently, the WTO offers four courses related to TRIPS on its eLearning platform: Trade Related Aspects of Intellectual Property Rights, as well as a Short Trip through TRIPS, Copyright in the WTO and Patents in the WTO. They were developed using modern pedagogical approaches and using instructional design methodologies. The learning material includes a wide variety of multimedia, interactive elements and exercises.
  3. WTO eLearning courses are organized in English, French and Spanish all year round. Participants have online access to the course material, background documents, interactive sessions (webinars, chat sessions and discussion forum) as well as pre- and post-tests. Successful participants in the eLearning courses are awarded a certificate. They are assisted throughout the course by a trainer and a helpdesk. In the invitations to workshops and more advanced technical assistance activities on the TRIPS Agreement, the Secretariat has prioritized candidates having successfully completed a WTO TRIPS eLearning course.

5  COOPERATION WITH IGOs AND OTHER INSTITUTIONS

  1. The Secretariat's technical cooperation in the area of TRIPS includes a wide range of coordination and cooperation with other IGOs, as well as other institutions.
  2. Trilateral Cooperation with the WIPO and WHO Secretariats in the fields of public health, trade and IP continues to foster a better understanding of the linkages among these policy areas, and to enhance a mutually supportive implementation of relevant policies. In February, the Directors-General of the WHO, the WIPO and the WTO reaffirmed their commitment to working closely together to help overcome the COVID-19 pandemic and its human, social, and economic impacts. The three Directors-General also reviewed progress made on the initiatives announced in their joint statementof 15 June 2021, pledging cooperation on COVID-19-related medical technologies and charting future directions for their organizations' trilateral cooperation to ensure it continues to address the evolving needs of people across the globe.
  3. As provided for in the 1995 Cooperation Agreement between WIPO and WTO, cooperation between the two organizations continues to be a key feature of TRIPS-related technical cooperation. The WIPO‑WTO Joint Initiative on Technical Cooperation for least developed countries, launched in June 2001, further strengthened this collaboration.
  4. Partnerships with other key stakeholders have also been further developed, including the ITC, United Nations Technology Bank for LDCs, UNFCCC, UNEP, in addition to a wide range of civil society and private sector associations, as well as experts from academia (notably regionally based experts drawn from the growing group of alumni from the WTO-WIPO Colloquium series.
