168. The Chairman clarified that these three agenda items had been discussed in two contexts: one was in the regular session of the Council for TRIPS and the other was in the context of the consultations on outstanding implementation issues. The regular session of the Council was required to report to the General Council, but not required to report to the TNC. The Council's annual report would cover its work on these three items. He proposed that the Council keep these agenda items open in order to allow further consultation on how it should report on these matters.
