G DECISION ON THE IMPLEMENTATION OF PARAGRAPH 6 OF THE DOHA DECLARATION ON THE TRIPS AGREEMENT AND PUBLIC HEALTH
191. The representative of Switzerland reconfirmed his delegation's commitment to the amendment process and to the conclusion of the work before the Hong Kong Ministerial Conference. As regards the transposition of the solution of 30 August 2003 into the TRIPS Agreement, it was of key importance for his delegation that the amendment reflected the entirety of the consensus and the solution found by the membership at that time. This could only be done through a purely technical amendment which would faithfully reflect the consensus which had been achieved only after very long and difficult negotiations and which represented a delicate balance of interests of WTO Members. The Chairman's Statement was part of the consensus and should therefore also be an integral part of the solution. It needed to be adequately reflected in the amendment. He recalled the Doha Declaration on the TRIPS Agreement and Public Health and the flexibilities recognized therein in relation to other important concerns referred to by some delegations. His delegation supported the process of informal consultations held by the Chairman. If those consultations were extended to other delegations at a later stage, his delegation was interested in being included in the process, given that Switzerland was a major player in pharmaceutical research and development.
