10. The Chairman suggested that Members continue to discuss the three agenda items together as had been the practice at the TRIPS Council's past meetings. He recalled that, in paragraph 44 of the Hong Kong Ministerial Declaration, Ministers had taken note of the work undertaken by the TRIPS Council pursuant to paragraph 19 of the Doha Ministerial Declaration and agreed that this work shall continue on the basis of paragraph 19 of the Doha Ministerial Declaration and the progress made in the TRIPS Council to date. The General Council shall report on its work in this regard to the next Session of the Ministerial Conference. He had held consultations on how the TRIPS Council should organize its future work in the light of the Hong Kong Ministerial Declaration, in particular its paragraph 44 on "Doha paragraph 19". He suggested that Members come back to that issue after their substantive discussion.

Turning to the substantive discussion, he recalled that two new documents had been presented to the Council's October meeting, one from Peru containing a case study on the camu-camu fruit (IP/C/W/458); and another from India, on behalf of Bolivia, Brazil, Colombia, Cuba and Pakistan, (IP/C/W/459), containing technical observations on an earlier US submission, (IP/C/W/449). The Council had received two new communications, one from the United States (IP/C/W/469) and another from Bolivia, Cuba, Ecuador, India, Sri Lanka and Thailand (advance copy of IP/C/W/470).
12. He recalled that, in August 2002, as requested by the Council, the Secretariat had circulated three summary notes of issues raised and points made on these three agenda items in documents IP/C/W/369, 368 and 370, respectively. At its meeting in September 2002, the TRIPS Council had requested the Secretariat to periodically update these three summary notes, not after every meeting, but when significant new material would have been presented. After initially circulating updated versions of these three notes as JOB documents to Members for comments, the Secretariat had circulated revisions of the three notes in documents IP/C/W/368/Rev.1 and Corr.1, 369/Rev.1 and 370/Rev.1.
