154. The representative of Argentina said that she shared the concerns raised by Brazil and India relating to the seizure of cargoes of generic drugs in transit through the European Communities. She believed that when authorities made decisions in such cases, they should had taken into account the need to facilitate access to medicines for developing and least-developed countries. The seizures contradicted GATT Article V and were not consistent either with the spirit of the TRIPS Agreement, with the flexibilities contained in it or with the Doha Declaration on the TRIPS Agreement and Public Health.
