The representative of China said that she believed that it was any Member's right to make agenda proposals to the Council for TRIPS without any procedural requirement to explain the proposed agenda item through a communication or any other form of document. While it was true that, due to the workload of the Council for TRIPS and other WTO bodies, her delegation had not provided detailed information of the agenda item, India had already pointed out that the agenda item was itself descriptive and gave Members a sense of the topic that was to be discussed. China agreed that enforcement was a long term issue, but the publication of the draft Anti Counterfeiting Trade Agreement (ACTA) in April 2010 had added a new element. This was why her delegation hoped to have the opportunity at the present meeting to express its views on this important event and on other developments. She said that if that opportunity was given, her delegation would give a full explanation of why this issue was raised and what were the concerns of China and other Members. China believed that the WTO was a forum in which Members could discuss issues relevant to the Council for TRIPS, and she insisted that the agenda be adopted.
