388. The representative of Ecuador said that Article 7 of the TRIPS Agreement provided that intellectual property should be conducive to social and economic welfare, and to a balance of rights and obligations. He believed that the proposal presented by several delegations in previous and the present meetings regarding the recommendations of Cluster A of WIPO Development Agenda were relevant for the work on this agenda item because they contained information that provided a clear work plan based on development for the area of IPRs in the WTO. Technical cooperation and capacity building should not just be limited to ensuring the compliance with obligations but also extended, with the same level of intensity and commitment, to the flexibilities in the TRIPS Agreement. It would be interesting if developed country Members could provide to the Council's next meeting addressing this topic details on the capacity building and technical assistance programmes on, and use made of, the TRIPS flexibilities.
