In accordance with paragraph 3 of Article 1 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, Australia will not apply the criterion of publication provided for in paragraph 1(c) of Article 5 of the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done on 26 October 1961. In accordance with paragraph 3 of Article 1 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, Australia declares that it will protect broadcasts only if the headquarters of the broadcasting organization is situated in another Contracting State and the broadcast is transmitted from a transmitter in the same Contracting State as provided for in paragraph 2 of Article 6 of the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done on 26 October 1961. In accordance with paragraph 1 of Article 3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, Australia will not apply the requirement, in item (d) of Article 13 of the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done on 26 October 1961, to provide broadcasting organizations with a right to authorize or prohibit the communication to the public of their television broadcasts if such communication is made in places accessible to the public against payment of an entrance fee
