I have been instructed by the Government of Hong Kong to notify the Council for TRIPS in relation to TRIPS Article 1.3 of the following: -Hong Kong will not apply in respect of phonograms the criterion of fixation as provided under Article 5 of the Rome Convention; -Hong Kong intends to protect broadcasts only if the headquarters of the broadcasting organization is situated in another Member and the broadcast was transmitted from a transmitter situated in the territory of the same Member as provided under Article 6 of the Rome Convention.
