2. Description
Concerning the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement), the Government of the Former Yugoslav Republic of Macedonia has the honour to inform the Council for Trade-Related Aspects of Intellectual Property Rights of the following declaration made upon its accession: The Former Yugoslav Republic of Macedonia, in accordance with Article 1, paragraph 3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, will not apply the criterion of publication referred to in Article 5 paragraph 1 (c) of the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations, done at Rome on 26 October 1961 (Rome Convention) as regards the protection of producers of phonograms. The reservation of non-appliance of the above-mentioned criterion of the Rome Convention has already been expressed by the Former Yugoslav Republic of Macedonia upon the ratification of the Convention. The competent authority in the Former Yugoslav Republic of Macedonia is the Ministry of Culture.
