Regulations Governing Application for Approval of License of Works of Unknown Owner of Copyrights and Royalties for Use Thereof
In force since 2010, the Development of the Cultural and Creative Industries Act promotes, among other things, the use of orphan works. The statute provides that, where it is impossible to obtain copyright permission because the identity or location of a work’s economic rights holder is unknown, the copyright user may apply directly to the copyright-competent authority for authorization to use said work. In order to ensure the effective implementation of this provision, the above regulations were also enacted; these stipulate what documents are required for license application, what procedures must be followed, and how royalties are set.
