Law No. 230 of 28.07.2022 on Copyright and Related Rights
The purpose of the Law 230/2022 is to ensure the protection of the copyright and related rights in the Republic of Moldova. The Law 230/2022 replaced the former Law on Copyright and Related Rights 139/2010. In relation to the former Law 139/2010, the new Law no.230/2022 seeks to improve the copyright system in Moldova, adjusting it to the technological developments and digital environment and to enhance the efficiency of the collective management system, in line with the international treaties and EU legislation in the field. Thus, the new act ensures the implementation of the provisions of the Beijing Treaty on Audiovisual Performances, Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired, or Otherwise Print Disabled. It also transposes a series of European directives, including Council Directive 93/83/EEC of 27 September 1993, Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996, Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 etc. The Law 230/2022 partially transposes the provisions of the Directive 2014/26/EU of the European Parliament and of the Council of 26 February 2014 on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market, Directive (EU) 2019/789 of the European Parliament and of the Council of 17 April 2019 laying down rules on the exercise of copyright and related rights applicable to certain online transmissions of broadcasting organisations and retransmissions of television and radio programmes, and amending Council Directive 93/83/EEC and Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on Copyright and Related Rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC.
The Law No. 230/2022 on Copyright and Related Rights was adopted on 28.07.2022, published on 09.09.2022 in the Official Gazette No. 278-282 and entered into force on 09.10.2022.
