The Permanent Mission of the Philippines to the Unites Nations and Other International Organizations in Geneva presents its compliments to the Secretariat of the World Trade Organization and has the honour to inform the latter that the Philippines avails itself of the right of developing countries under Article 65.2 of the TRIPS Agreement, to delay for four years, beginning as of 1 January 1996, the date of application of the Agreement. The Philippines Mission also wishes to inform the Secretariat that Philippine Republic Act No. 165 does not exclude from patentability inventions relating to pharmaceutical and agricultural chemical products, and therefore Article 70.8 of the TRIPS Agreement does not apply to the Philippines.
