Enforcement Rules of the Patent Act
The procedural requirements of filing patent applications and divisional patent applications are modified to align with the amended Patent Act on January 18, 2017. Accordingly, claiming grace period at the time of filing is no longer required.
Most recent amendments: Articles 26, 51 and 53: amended on June 29, 2016 and entered into force on July 1, 2016 - The amendments prescribe that applicants who submit certificate copies of the priority document in electronic form will no longer be required to submit the original copies of the said document. - Some technical terms for design patents were changed to better reflect the examination practices for design patents as well as Article 136 of the Patent Act. Article 86: amended on March 7, 2016 and entered into force on March 9, 2016 - The applicant wishing to postpone publishing a patent may make a request to the Specific Patent Agency at the time of paying patent certificate fee and the first year patent annuity fee. The time period that the publication of a patent may be postponed is extended from 3 to 6 months.
