Commercial Procedural Code of Ukraine
Article 16 establishes exclusive jurisdiction of cases in disputes related to infringements on proprietary intellectual property rights. Under Article 16, infringements of proprietary intellectual property rights, in particular, of the right to an industrial design, shall be subject to examination by an economic court at the venue of the committed infringement. Under Article 16, infringements of proprietary intellectual property rights shall be subject to examination by an economic court at the venue of the committed infringement. Under Article 16, infringements of proprietary intellectual property rights, in particular of the right to a layout (topography) of integrated microcircuits, shall be subject to examination by an economic court at the venue of the committed infringement. Article 1 of the Commercial Procedural Code of Ukraine establishes the right of a person to go to an economic court seeking protection of one’s infringed or disputed rights and of interests protected by law. Article 38 provides that where evidence presented by the parties is insufficient, the economic court concerned shall be obliged to demand that the enterprises and organizations involved submit such materials as are necessary for the settlement of the dispute at hand. Article 43-1 establishes the right of a person to submit to an economic court, a request for taking preventive measures. Article 43-10 establishes the right to compensation of damages caused by such preventive measures. Article 43-1 of the Commercial Procedural Code establishes the right of a person to submit to an economic court a request for taking preventive measures.
