L ENFORCEMENT OF INTELLECTUAL PROPERTY RIGHTS – COMMUNICATION FROM THE EUROPEAN COMMUNITIES
127. The representative of Argentina said that, while she shared the same preoccupation regarding the enforcement of IPRs and piracy and counterfeiting, she was concerned about the way in which some delegations were presenting this issue before the Council. Article 68 of the Agreement did not create any new overseeing power for the Council. Members identifying problems or omissions regarding the way other Members had implemented their TRIPS obligations had at their disposal the provisions of Article 63 of the Agreement. It seemed to her delegation that the objective of the EC proposals in IP/C/W/468 was to give to the Council new powers which it did not have, such as a de facto rule-making power. Furthermore, there were other bodies outside the WTO also dealing with the issue of enforcement. She expressed the same concerns regarding the EC paper on border enforcement measures, including its implicit suggestion to revise Article 51 of the Agreement. She reiterated the proposal that she and certain other delegations had made at the Council's last meeting that this issue not be kept on the agenda, given that issues relating to enforcement could be analyzed under the review mechanisms already foreseen under the Agreement.
