100. The Chairman informed the Council that, by means of a joint communication, dated 4 December 2008, China and the European Communities had informed the Dispute Settlement Body that they had reached agreement in the form of a Memorandum of Understanding regarding the matter raised by the European Communities in the dispute China – Measures Affecting Financial Information Services and Foreign Financial Information Suppliers. This Memorandum of Understanding had been circulated to the TRIPS Council in document IP/D/27/Add.1. 101. Regarding the status of acceptances of the Protocol Amending the TRIPS Agreement, done at Geneva on 6 December 2005, he informed the Council that since its meeting in October, the following Members had deposited their instruments of acceptance: Brazil on 13 November; Morocco on 2 December; and Albania on 28 January (documents WT/Let/636, 638, and 639, respectively). The Secretariat had circulated an update to the note on the status of acceptances of the Protocol (IP/C/W/490/Rev.4) and would continue to update it periodically. As Members were aware, the Protocol was open for acceptance by Members until 31 December 2009 or such later date as might be decided by the Ministerial Conference. He encouraged those Members that had not yet notified their acceptance of the Protocol to ensure that necessary measures were being taken in their capitals to allow the consideration of the acceptance in a timely fashion.
