M.iii Public health dimension of the TRIPS Agreement
156. The representative of South Africa supported the position taken by Brazil and India and expressed concern about the continued EC practice in this particular matter. South Africa fully complied with its obligations under the TRIPS Agreement and with any other international obligations it might have undertaken. A distinction between legitimate and illicit trade in generic medicines should be made. Insofar, as developing countries had the right to access to generic medicines, it was regrettable that the European Communities was interfering with these particular rights. His delegation was also concerned that EC actions had systematically escalated over the last few months. He called upon the European Communities to cease its unlawful behaviour and to bring its domestic regulations in line with its WTO obligations.
