C.2.i Procedures for giving effect to the obligation to notify implementing legislation under Article 63.2

The Chairman said that the starting-point for the discussions on this item today was the "Working Hypothesis" for procedures for the notification of, and possible establishment of a common register of, national laws and regulations under Article 63.2 which had been distributed as document IP/C/W/6 following the Council's deliberations on the matter at its previous meeting. He recalled that, at that meeting, there had been general support for the overall approach of the "Working Hypothesis" while it had been recognized that certain issues needed further exploration and some delegations wanted more time to study the paper. In the meantime, the Council had agreed that the paper would be used as a basis for consultations with WIPO. He suggested that the Council postpone consideration of those parts which related to cooperation with WIPO until the agenda item concerning arrangements for cooperation would be discussed and focus, at this stage, on the three documents circulated by the Secretariat as requested by the Council at its previous meeting, i.e. the draft schedule for the consideration of national implementing legislation in 1996 (IP/C/W/7), the draft format for the listing of "other laws and regulations" to be notified under Article 63.2 (IP/C/W/8) and a first draft of a checklist of issues on enforcement (IP/C/W/9). He invited delegations' specific reactions to these documents and any other suggestions relating to the parts of the "Working Hypothesis" which did not concern cooperation with WIPO.
