A Notifications under Article 4(d)
9. The representative of Japan said that, building on the useful guidelines in the Secretariat note, notifications under Article 4(d) should not only refer to the title of the agreement notified, but also be accompanied by its text, the names of the contracting parties, the date of its entry into force and a brief explanation of the privilege provided under it which was the reason for its notification. This would not be an unnecessary burden for delegations, but would provide important additional information that could assist the TRIPS Council in reviewing the notifications. These elements should be taken into consideration in the preparation of a format for notifications under Article 4(d). The representative of Australia supported Japan, adding that simply listing a number of agreements in a notification under Article 4(d), as many Members had done, did not lead to the transparency required by the provisions in question.
