The Danish Government hereby notifies to the Council for Trade-Related Aspects of Intellectual Property Rights that Denmark makes the following declarations in accordance with the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations (the Rome Convention of 1961) and Article 1, paragraph 3, and Article 14, paragraph 6, of the TRIPS Agreement.
- With regard to Article 5, paragraph 3, of the Rome Convention, Denmark will not apply the criterion of publication in Article 5, paragraph 1(c).
- With regard to Article 17 of the Rome Convention, the Government of Denmark hereby withdraws its notification concerning the sole application of the criterion of fixation in relation to the protection of phonogram producers . This withdrawal of the notification shall take effect as of the same date as the notification pursuant to Article 5, paragraph 3, becomes effective.
The notifications are based on an amendment of the Danish Copyright Act. The competent authority in Denmark is the Ministry of Culture.
