Copyright and Related Rights Act, 2000 (Act No. 28 of 2000)
This Act contains provisions in respect of copyright, protection of the rights of performers and rights in performances, it also contains provisions for licensing and registration schemes for copyright and related rights. The Act restates the law in respect of Council Directive 91/250/EEC on the legal protection of Computer Programs and Council Directive 93/98/EEC on Harmonising the Term of Protection of copyright and certain related rights (giving effect to Article 2.1). It also gives effect to: Council Directive 92/100/EEC on Rental and Lending and on certain rights relating to copyright in the field of intellectual property; Council Directive 93/83/EEC on the Co-ordination of Certain Rules Concerning Copyright and Related Rights related to Copyright applicable to Satellite Broadcasting and Cable Retransmission; Council Directive 96/9/EC on the Legal Protection of Databases; and provides for other related matters.
The Act entered into force on January 1, 2001 (except Sections 98,198, 199 and 247 - Section 198 was subsequently commenced on 1st May 2007).
This Act repealed the Copyright Act 1963 (entire Act other than section 59); the Performers' Protection Act 1968 and the Copyright (Amendment) Act 1987. It also repealed sections 2 & 3 of the Intellectual Property (Miscellaneous Provisions) Act 1998 and amended section 23 of the Trade Marks Act 1996. In addition, the Act revoked the European Communities (Legal Protection of Computer Programs) Regulation 1993 (S.I. No. 26 of 1993) and the European Communities (Term of Protection of Copyright) Regulations 1995 (S.I. No. 158 of 1995).
