Trade Marks Act, No. 194 of 1993.
This Act provides for the registration of trade marks, certification trade marks and collective trade marks. The duration of registration is 10 years, renewable indefinitely. It renders dilution unlawful. Further it has specific provisions for the protection of wellknown foreign trade marks.
(Sections 42 and 43 of the Trade Marks Act, No. 194 of 1993 are relevant for the protection of geographical indications as notified in IP/N/1/ZAF/G/1) These Sections provide for the protection of registered certification trade marks and collective trade marks respectively. Geographical indications may be registered in the form of collective trade marks or in the form of certification trade marks and thus be protected in South Africa.
