N.ii The proposal of the African Group
218. The representative of India supported the proposal by the African Group. He believed that what the African Group had proposed in paragraph (b) was somewhat different from what the United States had understood it to be. What the African Group was trying to address in its proposal was what was the definition of, and what constituted, exclusive marketing rights, and what kind of rights the holder of those rights would get. These were relevant questions since Article 70.9 did not define, for example, the difference between the rights conferred by patents and the rights conferred by the exclusive marketing rights.
