H REVIEW OF THE APPLICATION OF THE PROVISIONS OF THE SECTION ON GEOGRAPHICAL INDICATIONS UNDER ARTICLE 24.2 OF THE TRIPS AGREEMENT
98. The representative of Australia welcomed the flexible approach expressed by the European Communities. Australia was willing to discuss the application of the TRIPS GI provisions and remained open to addressing any issues of concern Members might have in that regard consistent with Article 24.2. In terms of structure, Australia proposed a systematic and focused approach which would entail going through each provisions of the TRIPS Agreement, one by one. As regards the approach proposed by the European Communities to use of the headings in the Secretariat summary paper of 2003, he wished to have a better understanding of the purpose of the exercise and what was driving the EC approach. He also questioned the currency of the Secretariat's paper, recalling that many Members, including proponents of increased protection, had not responded to the Checklist of Questions that formed the basis of the summary. He welcomed the responses received from Honduras. In determining the structure of future work, it had to be kept in mind that Article 24.2 was a surveillance provision that allowed Members to raise any concerns they might have regarding the application of the relevant provisions. In the past it had been used for that purpose.
