I TECHNICAL COOPERATION AND CAPACITY-BUILDING
82. The representative of India recognized the importance of technical cooperation and capacity building and supported Brazil's comments on the linkages between the work in the WTO and in WIPO as reflected in the proposal in IP/C/W/513. There was a clear link between the work in the TRIPS Council and the thirteen proposals on technical assistance and capacity building issues contained in "Cluster A" of the Development Agenda that had been adopted by the WIPO General Assembly in 2007. Some of the recommendations referred to the TRIPS Agreement and one to the agreement between WIPO and the WTO. Clause 3 provided a relevant guiding framework for discussions in the TRIPS Council. As stated by Egypt, technical assistance activities should be demand-driven, transparent, neutral and accountable and take into account the special needs of developing countries, in particular LDCs. This would facilitate effective compliance with the obligations under Article 67 and make the implementation fully development-oriented and contribute to balanced implementation of the TRIPS Agreement in light of the objectives and principles laid down in its Articles 7 and 8.
