Ambassador Karen Tan (Singapore)
C; D; E REVIEW OF THE PROVISIONS OF ARTICLE 27.3(B); RELATIONSHIP BETWEEN THE TRIPS AGREEMENT AND THE CONVENTION ON BIOLOGICAL DIVERSITY; PROTECTION OF TRADITIONAL KNOWLEDGE AND FOLKLORE
37. The representative of Australia said that, as a mega-diverse country with an indigenous population, Australia took these issues very seriously. Australia was actively engaged in discussions on the issue of genetic resources in WIPO, which was the most appropriate forum for discussion. With respect to the Bolivian submission (document IP/C/W/545), she said that her delegation was still considering that document and would respond with comments at the next meeting of the TRIPS Council. Responding to the statements made by Switzerland, China and India, she reiterated Australia's view on the parallelism of three TRIPS-related issues. Regarding the disclosure requirements, she said that these indeed merited further consideration but there was no agreed negotiating mandate to include this issue in the Doha Round. She asked for China's proposal of footnotes to Article 29 or Annex to the TRIPS Agreement in writing so that her delegation could consider the proposal in detail.
