3. The representative of India said that adequate notice had been given for agenda item M as per the rules of procedure. In his view, the nomenclature of the agenda item was sufficiently descriptive to convey the intended topic of discussion. He also referred to Article 68 of the TRIPS Agreement which stated that the Council for TRIPS "shall monitor the operation of this Agreement" and that it "shall afford Members the opportunity of consulting on matters relating to trade related aspects of intellectual property rights". It was under these provisions that India had brought the agenda item.
