58. The representative of Angola, speaking on behalf of the LDC Group, said that the relationship between the TRIPS Agreement and the CBD and GI extension were two outstanding implementation issues under the negotiation mandate of the WTO Director-General in accordance with paragraph 39 of the Ministerial Declaration. 59. The work on the TRIPS-CBD issue aimed at combatting biopiracy and preventing the misappropriation of genetic resources and associated traditional knowledge. The LDC Group, together with a large number of Members, supported a proposal making it mandatory for patent applicants to disclose the origin of genetic resources and associated traditional knowledge. 60. In the Dar es Salaam Declaration, LDC Ministers had requested that the TRIPS Agreement be amended to include a mandatory requirement for the disclosure of the country of origin of genetic resources, and/or associated traditional knowledge, for which a definition would be agreed on in patent applications. Further, LDC Ministers had requested to include a requirement to process patent applications only on completion of the disclosure requirement, as well as an agreement to define prior informed consent and access and benefit sharing. 61. The LDC Group encouraged the Director-General to proceed with his consultations on those two outstanding implementation issues. Furthermore, the LDC Group shared the view that the CBD Secretariat should be invited to the Council to brief Members on the outcome of the Nagoya Protocol and update them on the on-going process following the Nagoya Conference aimed at addressing the remaining issues, such as the international certificate of compliance, bearing in mind the parallel process on-going in other forums.
