The Chairman recalled that, if a Member sought to justify an exception to the m.f.n. rule on the basis of an international agreement relating to the protection of intellectual property which had entered into force prior to the entry into force of the WTO Agreement, Article 4(d) required that such an agreement be notified to the Council for TRIPS. The first part of paragraph 12 of document PC/IPL/7/Add.2 raised one or two questions related to this provision.
38. As there were no statements made on this issue, the Chairman proposed that the Council revert to Article 4(d) at a later stage and that informal consultations be held on this matter in the meantime.
