C Notifications under Article 4(d)
13. The representative of the United States said that he hoped that delegations would indeed reflect on the notifications they had made in the light of the informal Secretariat note referred to and of the clarifications that the informal consultations had already yielded, and would be in a position to focus their notifications considerably. He reiterated his delegation's opinion that a Member could only avail itself of the provisions of Article 4(d) if it identified the discriminatory element(s) of the international agreement notified. Otherwise, the Council would not be in a position to decide whether or not a notified agreement contained discriminatory element(s) that were arbitrary or unjustifiable and, therefore, whether or not that agreement could benefit from the provisions of Article 4(d).
