The Regulatory Reform (Registered Designs) Order 2006
The Order amends the Registered Designs Act 1949. Section 1A which set out the substantive grounds for refusing to register a design, section 3(4) which gave the registrar the power to make searches for determining whether a design was new or had individual character, and sections 22(2) & (3) concerning restrictions on inspecting certain registered designs, are repealed. Section 3A(4) is substituted by a new provision that sets out the remaining substantive grounds for refusing to register a design. Further amendments permit an application to include multiple designs and the criteria concerning failure to pay renewal fees on time is amended. Additional consequential amendments are made under the Rules.
