Intellectual Property (Unjustified Threats) Act 2017

The Unjustified Threats Act 2017 extends the changes made to the unjustified threats law for patents in 2004 to trade marks and designs (allows a rights holder to challenge someone capable of causing the most damage, usually the trade source of the infringement, without fear of being sued for making unjustified threats), strikes a balance in allowing right holders to protect their IP assets but not to misuse threats, protects customers and those within the supply chain against unjustified threats, provides a framework within which disputing parties can exchange information to resolve issues and avoid litigation, protects professional advisers from personal liability for making threats when they act for their clients, and makes changes to the law that are necessary so that the protection against unjustified threats applies to European patents.
