Canada has amended its Patent Rules (SOR/2019-251) to streamline the patent examination process to better ensure efficient and timely processing of patent applications. The amendments also enable Canada to meet certain international commitments under the Patent Cooperation Treaty. The amendments to Canada’s Patent Rules consist of two sets of amendments: sequence listing amendments and streamlining patent examination amendments. The sequence listing amendments, which entered into force on July 1, 2022, ensure compliance with the sequence listing requirements of WIPO Standard 26 (or ST.26). The streamlining patent examination amendments, which entered into force on October 3, 2022, introduce mechanisms to streamline patent examination, provide new safeguards to prevent loss of rights, and also contain housekeeping and miscellaneous amendments.
