Customs Code of Ukraine sets out principles for the organization and conduct of customs matters in Ukraine, regulates economic, organizational, legal, personnel, and social aspects of the Customs Service of Ukraine’s activities. The Code purports to assure the protection of Ukraine’s economic interests, the promotion of conditions favorable to the development of its economy, the protection of rights and interests of economic subjects and citizens, as well as the guarantees for the compliance with Ukrainian laws on customs matters. Section X sets out measures of customs authorities aimed at promoting the protection of intellectual property rights during the movement of goods across the customs border of Ukraine. Article 255 establishes the procedures for customs inspection and customs clearance of goods containing intellectual property right objects. Article 266 contains provisions pertaining to the Customs Register of intellectual property right objects. Articles 257 and 257-1 set grounds and procedures for suspending customs clearance of goods based on grounds of the data entered in the Register of intellectual property right objects. Article 258 establishes the procedure for the customs bodies’ cooperation with other state authorities in the field of protecting intellectual property rights in the course of performing supervision over the movement across the customs border of Ukraine of goods containing intellectual property right objects. Chapter 45 (Articles 255 through 258) provides for measures of customs authorities aimed at promoting intellectual property rights protection in the process of goods movement across customs border of Ukraine.
