The Law of Ukraine “On Foreign Investment Regime”

The Law sets out specific features of foreign investment regime in the territory of Ukraine proceeding from objectives, principles, and provisions of Ukrainian law. Article 21 establishes the right of enterprises with foreign investments to independently adopt decisions to patent (register) abroad intellectual property right objects owned by them, in accordance with Ukrainian law. Under Article 2 of the Law, foreign investments may be realized, inter alia, in the form of any intellectual property right, in particular, the right to an industrial design; at that, protection and enforcement of such rights of enterprises with foreign investments shall be assured in accordance with Ukrainian law. Under Article 2 of the Law, foreign investments may be realized, in particular, in the form of any intellectual property right, in particular, the right to an invention or utility model; at that, protection and enforcement of such rights of enterprises with foreign investments shall be assured in accordance with Ukrainian law. Under Article 2 of the Law, foreign investments may be realized, in particular, in the form of any intellectual property right, in particular, the right to a layout (topography) of integrated microcircuits; at that, protection and enforcement of such rights of enterprises with foreign investments shall be assured in accordance with Ukrainian law.
