Federal Law No. (7) of the year 2002 concerning copyrights and neighboring rights

Reference is made to your letter of 6 May 2003 in which you asked the UAE to notify its laws and regulations in conformity with Article 63.2 of the Agreement on Trade-Related Aspects of Intellectual Property Rights. The UAE has started its legislation review in the TRIPS Council meeting during the June 2001 Session during which the review has been undertaken on the basis of the already existing laws: the Patent and Designs Law, the Trademarks Law and the Copyright and Neighboring Rights Law. The review has also taken fully into account the amendments foreseen at this stage to be introduced to the above-mentioned laws. In its June 2002 Session, the TRIPS Council has decided to conclude this review process as far as the UAE intellectual property system reflects in full the TRIPS obligations. Also, the UAE has committed to notify the final version of these laws as soon as possible. In this respect, the UAE have the honour to inform the Council and the Members that the legislative and procedural process of approval has been accomplished and the concerned laws came into effect, namely: - The Federal Law No. (17) of the year 2002 (issued on 17 November 2002), pertaining to the industrial regulation and protection of patents, industrial drawings and designs. - The Federal Law No. (8) of the year 2002 (issued on 24 July 2002), amending the Federal Law No. (37) of the year 1992 in respect of trademarks. - The Federal Law No. (7) of the year 2002 (issued on 1 July 2002) concerning copyrights and neighboring rights. In accordance with Article 63.2 of the TRIPS Agreement, the UAE notifies the English version of the Federal Law No. (7) of the year 2002 concerning copyrights and neighboring rights. Concerning the two other laws, the translation of their contents is in progress. The UAE undertakes to communicate them to the WTO Secretariat as soon as their translation will be finalized.
