C.i Definition of the term "geographical indication" and eligibility of geographical indications for inclusion in the system

The representative of Brazil said that his country was in favour of the "joint proposal" by the delegations of Japan, Canada, Chile and the United States on the establishment of a system of notification and registration (IP/C/W/133/Rev.1). His delegation was of the view that country names could fit in the protection of geographical indications. As stated in the regular session of the TRIPS Council on the protection of "Cachaça", a spirit protected under Brazilian law, his delegation agreed to a great extent with the view that, evegn though there was a broad definition of geographical indications in Article 22.1, the parameters of protection might vary from one country to another. Geographical indications had a territorial nature; his delegation agreed to some of the elements raised by certain delegations regarding how to challenge geographical indications. The best way might be in the national forum where the geographical indication was protected. 60. Concerning Australia's experience with the use of the terms "Port", "vintage" and "ruby", he said that the problem did not seem to be a mistake in translation but rather a confusion of scope: geographical indications had nothing to do with traditional expressions. He agreed with Argentina that traditional expressions were out of the scope of the definition issue, and wondered if they were even related to intellectual property at all.
