92. The representative of the European Communities said that "ruby" was not a geographical indication in the EC, so there was no reason why it could not be used in jewellery. However, the test of consumer deception could be applied to those types of cases. He doubted that the consumer would be deceived by the use of a geographical indication on jewellery. The obligations or legal effects that notification of a geographical indication would carry under the EC proposed register would not cause new obligations because the exceptions would continue to be available. The exceptions could be exercised in a different way, through the opposition procedure, but that did not mean that they were no longer available.
