C.ii The purpose of the notification and registration system
95. The representative of Australia said that, in a system where a Member would lose its rights if it did not challenge after 18 months, then all Members would have to challenge the notified geographical indication because there would be a degree of uncertainty of their rights. Recalling the "Feta" cheese example, he said that it had taken eight years of court procedures, lobbying, costs and resources for the Germans, the Danish and others to challenge it. Where and how was the evidence in that case obtained? It was all European-centric and that was his delegation's concern. If a notified geographical indication were to be challenged and go to arbitration, an arbitrator would not know how a term should be regarded in the territory of the complaining country.
