128. The representative of Malaysia, speaking on behalf of the ASEAN Members, said that it was clear that negotiations should take place in the TRIPS Council. Hence, all WTO Members and acceding governments should be able to participate in the negotiations establishing the multilateral system. In terms of participation, it seemed that Members with geographical indications eligible for protection should have the opportunity to indicate their choice of participation. For those with no geographical indications for protection, it was not clear how they would then be able to participate in that system. The system would still be multilateral in the sense that all Members would have the opportunity to participate in the negotiations setting up the system and that it would be open for participation to all Members.
