C.ii The purpose of the notification and registration system
The representative of Australia said that the example given by the EC representative showed how far-reaching the EC's ambitions really were. On the basis of that example, Members would not be able to use the term "ruby" to describe a well-known, red, semi-precious stone. On the issue of substantive obligations, paragraph 29 of the EC paper (JOB(02)/70) stated that registration referred to a specific way of implementing the TRIPS requirement that differed from the common law approach based on case law. This would suggest that what the EC were proposing did restrict Members' rights and amounted to an increase of obligations.
