Ambassador Choi Hyuck (Korea)
G DECISION ON THE IMPLEMENTATION OF PARAGRAPH 6 OF THE DOHA DECLARATION ON THE TRIPS AGREEMENT AND PUBLIC HEALTH
183. The representative of the China informed the Council that his delegation was in the process of drafting domestic legislation to implement the Decision. Under national patent law, procedures would be established for the granting of compulsory licences to manufacture generic versions of eligible patented pharmaceutical products. This would cover the supply of the domestic market to address public health crises and the export to eligible importing countries in response to requests received from those countries. He fully supported the Chairman's efforts in relation to this very important issue and expected the Council to push hard for the completion of the amendment process. This would provide legal certainty for Members in the process of implementing the Decision.
